Stage 01 · Before you begin

1. Eligibility to participate

DBSS is built for two-party civil disputes where both sides want a private, structured way to submit values for their case double-blind/settle without the cost or uncertainty of litigation.

Who can participate

  • Individuals, businesses, or their authorized representatives
  • Parties on opposite sides of a single civil claim
  • Anyone with authority to settle on behalf of their party

What you will need

  • Email addresses for both parties
  • A clear description of the claim
  • Authority to enter a binding settlement
Stage 02 · Document review

2. Release agreement

Before any number is exchanged, both sides agree on the document that will be signed if a settlement is reached.

Two ways to start

  • Use the standard DBSS release template
  • Upload your own release for the other party to review
  • Either side may propose changes

Review process

  • Each side reviews and either accepts or proposes edits
  • A maximum of three review rounds of revisions are allowed
  • Both sides must approve before bidding can open
Stage 03 · The scheduled day

3. Settlement window

The settlement window is a single block of time — 9:00 am to 5:00 pm in the timezone you both agree on — when negotiation will take place.

Scheduling

  • Both parties pick a date that works for them
  • You confirm a single timezone for the session
  • Calendar invitations are sent to both parties

Review process

  • Both parties must be available and reachable
  • Bidding rounds run inside this window only
  • All rounds take place during your scheduled negotiation window
Stage 04 · The double-blind exchange

4. Bidding rounds

This is where DBSS earns its name. Both sides submit their figure at the same time, and neither sees the other unless a settlement occurs by matching or overlapping values, or by a party choosing to reveal their value.

How double-blind works

  • Each side enters a number privately each round
  • Numbers stay hidden from the other party unless a settlement is reached or a party reveals their value
  • After both submit, the system checks for match or overlap

Bid budget and scoring

  • Each side has 5 initial bids
  • After each round, you see a settlement potential score — not a number — describing how close you are
  • A "near settlement" state grants 5 additional bids to each side if the parties choose to continue
Stage 05 · Outcomes

5. Outcomes

Every session ends with one of three outcomes. None of them carry hidden penalties — you always know what comes next.

Settlement reached

  • Bids overlap, or both sides accept a final figure
  • The release agreement is generated for signing
  • The case moves to the post-settlement stage

No settlement / opted out

  • The session ends without a settlement
  • Either party may opt out at any time, with no penalty
  • You receive an option to escalate to mediation
Stage 06 · After a settlement

6. Post-settlement requirements

A reached settlement is a real, enforceable agreement. DBSS sends the completed release and settlement letter to both parties for signature.

Signing

  • The completed release and settlement letter is generated and sent via DocuSign
  • Both parties sign within 7 days of the session
  • Each party receives a fully executed PDF

After signing

  • The agreement is legally enforceable as written
  • A signed copy is retained securely on your case record
  • You can download your copy at any time
